TERMS & CONDITIONS
1. ABOUT THESE TERMS
This website is operated by Wax and Beans. Throughout these Terms & Conditions, the terms “we”, “us” and “our” refer to Wax and Beans.
These Terms & Conditions apply when you access our website, create an account, place an order with us or otherwise use our services.
Please read these Terms & Conditions carefully before placing an order. By using our website or purchasing from us, you agree to be bound by these Terms & Conditions together with any other policies referred to on our website, including our Privacy Policy and Returns Policy.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
Our online store is hosted by Shopify, which provides the e-commerce platform through which we sell our products and services.
2. USING OUR WEBSITE
You must use our website only for lawful purposes and in accordance with applicable UK law.
You must not:
- use the website for any unlawful or fraudulent purpose;
- attempt to gain unauthorised access to our website, systems or customer accounts;
- introduce viruses, malware or other malicious or technologically harmful material;
- scrape, copy or reproduce substantial parts of our website without permission;
- infringe our intellectual property rights or those of another person; or
- use the website in any way which could damage, disable or interfere with its operation.
We may suspend or restrict access to our website where we reasonably believe these Terms have been breached.
3. PRODUCTS
We sell products including vinyl records, CDs, merchandise, collectibles and other related goods.
We make reasonable efforts to ensure that product descriptions, photographs, formats, colours, specifications and other information displayed on our website are accurate. However, product images are illustrative. Colours and packaging may vary slightly from those shown. Artwork, packaging, hype stickers, obi strips, inserts, vinyl colours and other elements may also differ from promotional images supplied to us by labels, distributors or manufacturers.
Where a product is described as a particular colour or effect, particularly coloured, marbled, splatter or recycled vinyl, individual copies may vary as a natural consequence of the manufacturing process. Such reasonable variations do not necessarily mean that the product is faulty or incorrectly supplied.
4. AVAILABILITY
All products are subject to availability. Displaying a product on our website does not guarantee that it is available.
For limited editions, exclusive releases, signed products, Record Store Day releases and other high-demand items, we may limit the quantity that can be purchased by an individual, household, account, payment method or delivery address.
Where we reasonably believe that somebody is attempting to circumvent a purchase limit, including by placing multiple orders, we reserve the right to cancel some or all of those orders and issue a refund.
We may also cancel an order where stock is unavailable, there has been an obvious pricing or product information error, we are unable to obtain authorisation for payment or we reasonably suspect fraud or resale activity,
5. PLACING AN ORDER
When you place an order through our website, you are confirming to purchase the products in your basket. After placing an order, you will receive an automated order confirmation email. This confirms that we have received your order but does not necessarily mean that we have accepted it.
Our acceptance of your order takes place when we dispatch the goods, unless we expressly tell you otherwise. If we cannot accept your order, we will let you know and refund any payment already taken for the affected item or order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- an item is unavailable;
- there is an obvious pricing or description error;
- a payment cannot be authorised;
- purchase limits have been exceeded;
- we suspect resale activity;
- we suspect fraudulent activity; or
- circumstances outside our reasonable control prevent us from supplying the product.
6. PRICES AND PAYMENT
Prices are shown in pounds sterling (£) unless otherwise stated.
Prices displayed to UK consumers include VAT where VAT is applicable.
Delivery charges, where applicable, are shown separately during checkout.
We may change our prices at any time, but changes will not normally affect orders that we have already accepted. If we discover an obvious pricing error after you place an order, we may contact you to give you the option of purchasing the product at the correct price or cancelling your order.
Payment is taken when you place your order, including for pre-orders.
Payments are processed through the payment methods displayed at checkout.
7. PRE-ORDERS
A pre-order is an order for a product before its expected release or availability date.
Release dates shown on our website are based on information supplied to us by record labels, distributors, manufacturers or suppliers and are estimates rather than guaranteed delivery dates. Release dates can change, sometimes at short notice, for reasons outside our control.
If a release date changes, your pre-order will remain active and we will fulfil it when stock becomes available.
Payment for pre-orders is taken when the order is placed.
We may occasionally be informed by a supplier that the quantity of stock available to us (referred to as an allocation) has been reduced. If this reduction means that we cannot fulfil your pre-order, we will contact you, cancel the affected item and refund you.
Placing a pre-order does not create an absolute guarantee of supply where circumstances outside our reasonable control prevent us from obtaining the stock.
Where an order contains both in-stock and pre-order products, the order will be held until all products are available unless a separate delivery arrangement is agreed. If you want available items sent separately, please contact us. Additional postage charges may apply.
8. RELEASE DATES AND DELIVERY OF PRE-ORDERS
We aim to dispatch pre-orders so that customers receive them as close to the official release date as reasonably possible. However, we cannot guarantee delivery on release day. Our ability to dispatch a product depends upon stock reaching us from the relevant label, distributor or supplier.
Delays affecting manufacturing, distribution, transport or supply chains are outside our reasonable control. An estimated release date or dispatch date therefore does not form a guaranteed delivery date unless we expressly state otherwise.
9. LIMITED EDITIONS, EXCLUSIVES AND SIGNED ITEMS
Some products are produced in limited quantities and may sell out quickly.
Where we describe an item as limited, numbered, exclusive or signed, that description is based upon information supplied by the relevant label, distributor, artist, management company or manufacturer,
Where a signed item is supplied to us by an artist, label, distributor or management company, signatures may naturally vary between copies. Unless expressly stated otherwise, a product being advertised as “signed” does not mean that the customer will receive the exact mock-up shown on our website. Signatures may be in provided in long or short format and therefore may not replicate the signature in any mock-up illustration.
We may impose purchase limits on particularly limited products.
10. WAX AND BEANS EXCLUSIVE PRODUCTS AND COLLECTIBLES
We offer Wax and Beans exclusive products, promotional items, collectible items or products forming part of a particular series or campaign. Where an item is individually numbered, the number shown in promotional photographs is illustrative unless a specific number is expressly offered for sale.
We cannot accommodate requests for particular numbers.
Where a promotional or collectible item accompanies another product, availability may be limited to qualifying orders and subject to the conditions stated on the relevant product page.
11. DELIVERY
Available delivery methods and charges are displayed during checkout. Any delivery dates or timescales shown are estimates unless expressly stated otherwise.
Once an order has been dispatched, delivery will be carried out by Royal Mail or another delivery provider. We are not responsible for delays caused by circumstances outside our reasonable control.
Please ensure that the delivery address supplied when placing your order is complete and accurate to ensure the safe delivery of your order. If you notice an error in your delivery address, contact us as soon as possible. We cannot guarantee that an address can be changed after an order has begun being processed.
12. PICK UP / COLLECTION FROM STORE
Where Pick Up or another collection option is offered, we will notify you when your order is ready to collect. Please do not travel to the shop to collect an order until you have received confirmation that it is ready.
You may be asked to provide your order confirmation or other information reasonably required to identify the order.
For pre-orders, the release date shown on the website does not necessarily mean that the item will be ready to collect at opening time on that date. Please wait for your collection notification.
13. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES
For orders delivered outside the United Kingdom, additional customs duties, import VAT, taxes or handling charges may be payable when the parcel reaches the destination country. We cannot control the amount charged by overseas customs authorities and recommend checking the applicable rules in the destination country before ordering.
Unless expressly stated otherwise at checkout, these charges are not included in the price paid to Wax and Beans and are the responsibility of the recipient.
Customs procedures may delay delivery.
If an international parcel is returned to us because import charges were refused or the parcel was not collected, we may deduct reasonable costs incurred by us from any refund.
14. CANCELLING AN ORDER BEFORE DISPATCH
If you wish to cancel an order that has not yet been dispatched, please contact us as soon as possible. We will try to accommodate cancellation requests, but we cannot guarantee that an order can be stopped once it has entered our picking, packing or dispatch process.
You can cancel a pre-order at any time up to 3 days ahead of it's release date, as long as we haven't shipped your order yet. If your order has shipped, we can still process a cancellation once we receive your item back, but the P&P will not be refunded.
Your statutory cancellation rights for online purchases are explained below. Nothing in this section limits those statutory rights.
15. YOUR RIGHT TO CHANGE YOUR MIND
For most goods purchased online, UK consumers have a legal right under the Consumer Contracts Regulations 2013 to change their mind and cancel their contract within 14 days after receiving the goods. If an order is delivered in separate instalments, the cancellation period normally runs from the day after you receive the final item.
You must tell us within the applicable cancellation period that you wish to cancel. You then have a further 14 days to return the goods to us.
Unless the goods are faulty, incorrect or we agree otherwise, you are responsible for the cost of returning unwanted goods. We recommend obtaining proof of postage when returning an item.
Certain products are excluded from the statutory right to cancel. This may include sealed audio or video recordings or sealed computer software where the seal has been broken after delivery, personalised or bespoke goods and other products excluded by applicable consumer law.
Your statutory rights in relation to faulty, damaged, misdescribed or incorrectly supplied products are not affected.
16. RETURNS
If you wish to return an unwanted item, please contact us and follow the instructions in our Returns Policy.
Products being returned should be kept in the same condition as would reasonably be expected if you were examining them in a physical shop. You may be responsible for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
Where an item included a free gift, exclusive promotional item or other item supplied as part of the purchase, this should also be returned if the qualifying purchase is returned for a full refund. If the promotional item is not returned, we are entitled to deduct its reasonable value from the refund where legally permitted.
17. DAMAGED, FAULTY OR INCORRECT ITEMS
If your order arrives damaged, faulty, incomplete or incorrect, please contact us as soon as reasonably possible.
We will ask you to provide photographs of:
- the affected product;
- the packaging - inner and outer layers;
- the shipping label; and
- any visible damage.
This helps us investigate the issue and, where appropriate, raise a claim with the delivery company or supplier.
Nothing in these Terms affects your rights under the Consumer Contracts Regulations 2013.
Depending on the circumstances and your statutory rights, you may be entitled to a repair, replacement, price reduction or refund.
18. VINYL, PACKAGING AND MINOR COSMETIC IMPERFECTIONS
Vinyl records and their packaging are physical products and minor manufacturing or handling variations can occur. Small cosmetic imperfections to external packaging which do not materially affect the product may not necessarily make the goods faulty for the purposes of consumer law. However, this does not affect your statutory rights where goods are damaged, defective, misdescribed or not of satisfactory quality.
If you believe an item is faulty or has been materially damaged, please contact us with photographs so that we can assess the issue.
19. REFUNDS
Approved refunds will normally be made to the original payment method.
We will process refunds within the timescales required by applicable UK consumer law/ Your bank or payment provider may take additional time to make the refunded amount available to you.
Where you cancel an entire qualifying online order under your statutory cancellation rights, we will refund the standard outbound delivery charge where required by law. Any additional amount paid for an enhanced, express or premium delivery service does not have to be refunded beyond the cost of our standard delivery option.
All cancellations are subject to a cancellation fee as detailed below, which will automatically be deducted from your refund. This cancellation fee covers the cost of the fees taken by Shopify which we are unable to reclaim on refunded items:

Orders £100 - £199.99 = £10
Orders £200 - £299.99 = £20
Orders £300 - £399.99 = £30
Orders £400 - £499.99 = £40

20. EVENTS, LISTENING PARTIES AND SIGNINGS
Wax and Beans host or facilitate live performances, listening parties, signings, meet-and-greets and other events. Individual events may have additional terms which will be stated on the relevant event or ticket page.
Event capacity is limited, most often by UK Health and Safety laws and fire regulations.
Unless expressly stated otherwise, obtaining a ticket or place at an event does not guarantee seating. If you require seating, please contact us as soon as possible and we will try to accommodate your request.
Customers must comply with reasonable instructions from Wax and Beans staff and event personnel.
We reserve the right to refuse admission or require somebody to leave where reasonably necessary for safety, security, disruptive behaviour or serious breach of event conditions.
Where an event is cancelled or materially changed, any refund entitlement will depend upon the circumstances, the nature of the ticket or package purchased and your applicable legal rights.
Any event-specific rules displayed by Wax and Beans will apply in addition to these Terms.
21. RECORD STORE DAY AND OTHER LIMITED-RELEASE EVENTS
Record Store Day and similar limited-release events may operate under additional rules. Products will be limited and available on a first-come, first-served basis. Purchase limits may apply.
Unless expressly stated otherwise, we do not guarantee availability and an expression of interest, wishlist entry, enquiry or attendance at the shop does not constitute a reservation.
Any event-specific rules displayed by Wax and Beans will apply in addition to these Terms.
22. ACCOUNTS AND CUSTOMER INFORMATION
You agree to provide accurate and current information when placing an order or creating an account. Our collection and use of personal information is governed by our Privacy Policy.
You are responsible for maintaining the confidentiality of your account credentials. Please contact us if you believe your account has been accessed without permission.
23. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to websites or services operated by third parties. We are not responsible for the content, availability or practices of third-party websites.
Your use of third-party services may be governed by separate terms between you and the relevant provider. This may include payment providers, delivery providers and social media platforms.
24. INTELLECTUAL PROPERTY
Unless otherwise stated, the content of the Wax and Beans website, including our branding, text, graphics, photographs, design and original promotional materials, belongs to Wax and Beans or is used by us with permission. You may not reproduce, distribute, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.
Artist names, album artwork, label artwork and other third-party intellectual property remain the property of their respective owners.
25. REVIEWS, COMMENTS AND USER CONTENT
If you submit reviews, comments, photographs or other content to us or through our website, you must ensure that the content is lawful and does not infringe another person's rights. You must not submit content which is defamatory, threatening, discriminatory, obscene, fraudulent or otherwise unlawful. We may remove user-submitted content where we reasonably believe it breaches these requirements. Where you submit content for publication, you grant us permission to display and use that content for the purpose for which it was submitted.
26. WEBSITE INFORMATION
We take reasonable care to keep information on our website accurate and current. Occasionally, information may contain typographical errors, inaccuracies or omissions relating to product descriptions, release dates, availability, prices, promotions or delivery information. We will correct such errors when identified.
Nothing in these Terms permits us to avoid a contract or your statutory rights merely because we have made an error. Where an error affects an order you have placed, we will deal with it in accordance with applicable UK law.
27. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure to perform our obligations where this results from circumstances outside our reasonable control. Examples may include severe weather, industrial action, transport disruption, failure of suppliers or distributors, manufacturing delays, postal disruption, interruption of utilities or communications networks and other events that we could not reasonably prevent. Where such an event materially affects your order, we will take reasonable steps to minimise the effect and will contact you where appropriate.
Your statutory rights remain unaffected.
28. OUR LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so. In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded.
If you are a consumer, we are responsible for losses that are a foreseeable consequence of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for business losses suffered by consumers, including loss of profit, loss of business, business interruption or loss of business opportunity, where the products were purchased wholly or mainly for personal use.
Nothing in these Terms affects your statutory consumer rights.
29. PRIVACY
Your submission of personal information through our website is governed by our Privacy Policy. Please refer to our Privacy Policy for information about how we collect, use, retain and protect your personal information.
30. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time. The version applying to your order will normally be the version published on our website when you place that order. Any changes will be published on this page.
31. SEVERABILITY
If any provision of these Terms is found by a court or other competent authority to be unlawful or unenforceable, the remaining provisions will continue to apply.
32. WAIVER
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
33. GOVERNING LAW
These Terms & Conditions and any contract between you and Wax and Beans are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you will also retain any mandatory protections available to you under the law applicable where you live.
